Le 19 février 2014, le Denver Museum of Nature and Science a remis 30 vigango – statues de bois gravées à la mémoire des ancêtres des Mijikenda – au gouvernement kenyan.
89 Moche Archaeological Objects – Peru v. Johnson
After the discovery of the Moche site of Sipán (Peru) in the mid-eighties, many archaeological objects were looted and smuggled out of the country. In 1987, a smuggler who had been involved in the exportation of these objects to the United States contacted United States Customs agents and led to the eventual seizure of 89 Moche artifacts from Benjamin Johnson, a private collector. The government of Peru sued to retrieve the artifacts from Johnson. Peru’s claim was unsuccessful and the 89 archaeological objects remained in Johnson’s possession.
Afo-A-Kom – Furman Gallery and Kom people
The Afo-A-Kom is a wooden sculpture sacred to the Kom people, a tribal population of Cameroon. In 1966, it was stolen and subsequently sold to a New York art dealer.
Collection japonaise de Netsuke – Winkworth c. Christie’s
Une collection de Netsuke est dérobée en Angleterre, vendue à un collectionneur de bonne foi en Italie et finalement proposée aux enchères en Angleterre. William Winkworth, le propriétaire originaire, reconnaît les objets sur le catalogue de la maison de vente aux enchères Christie’s et agit en justice à Londres afin de voir reconnaître sa propriété sur les biens.
Dancing Shiva Statue – India and National Gallery of Australia
In 2006, New York art dealer Subhash Kapoor arranged the theft and illegal exportation of a 900-year old bronze statue of the Dancing Shiva from a small temple in Southern India. In 2008, the National Gallery of Australia bought the statue for AUD$5.6 million.
Durga Idol – India and Germany
In the 1990s, a 10th century idol representing the Indian Goddess Durga was reported as stolen from a temple in Tengpora, Pulwana in the state of Jammu and Kashmir in India. The idol was found at the Linden Museum in Stuttgart in 2012. After presenting the evidence of its provenance, the idol was returned to India on “ethical grounds”.
Egyptian Archaeological Objects – United States v. Frederick Schultz
On 16 July 2001, Frederick Schultz, a New York antiquities dealer, was indicted on one count of conspiring to receive stolen Egyptian antiquities in violation of the National Stolen Property Act (NSPA). Under the NSPA, it is a crime to deal in property that has been “stolen, unlawfully converted or taken, knowing the same to be stolen”.
Etruscan Black-Figured Kalpis – Italy and Toledo Museum of Art
After an extensive investigation by U.S. Immigration and Customs Enforcement (ICE) and Homeland Security Investigations, the Toledo Museum of Art returned in 2013 an Etruscan black-figure kalpis to Italy. The kalpis was found to be smuggled out of Italy after an illegal excavation prior to 1981, then sold to the Toledo Museum of Art in 1982 by Gianfranco and Ursula Becchina, who had earlier purchased it from the art smuggler Giacomo Medici.
Euphronios Krater and Other Archaeological Objects – Italy and Metropolitan Museum of Art
In February 2006, the Italian Ministry for Cultural Heritage and Activities and the Metropolitan Museum of Art (MET) of New York entered into a landmark agreement with which the ownership title to the Euphronios Krater and other archaeological artefacts was transferred to the Italian Government.
G’psgolox Totem Pole – Haisla and Sweden and the Stockholm Museum of Ethnography
In 1927, a totem pole belonging to the Haisla tribe in Canada was stolen and brought to the Stockholm Museum of Ethnography. In 1991, the tribe discovered the location of their totem pole, known as the G’psgolox totem pole, and requested that it be returned. After fifteen years of negotiations, the G’psgolox totem pole was formally returned to the tribe in 2006.
Ka Nefer Nefer Mask – United States v. Mask of Ka Nefer Nefer
On July 28, 2014, the Eighth Circuit Court of Appeals denied the request of the United States Government to take further legal action regarding the St. Louis Art Museum’s ownership of the 3200 year old Egyptian Ka Nefer Nefer funerary mask.
Khmer Statue – Cambodia and Sotheby’s and the United States
In March 2011, Sotheby’s offered at auction in New York a Khmer statue. The statue was pulled out of the sale as a result of Cambodia’s request for its restitution. Cambodia claimed that it was illegally removed from the site Koh Ker during the 1970s and should be returned to them.

En novembre 2016, il est porté à la connaissance de l’archiviste d’État de Genève qu’un document datant du XVIe siècle et volé probablement au XIXe siècle figure sur le catalogue de la prochaine vente aux enchères de Sotheby’s à New York. Un accord d’indemnisation est signé le 1er septembre 2017 entre Sotheby’s, le possesseur et deux intervenants privés. Le même jour, un accord distinct de restitution est signé entre la République et canton de Genève, Sotheby’s et le possesseur.
Manuscrit du Marquis de Sade – Héritier Nordmann et héritier de Noailles et Gérard Lhéritier
Les « Cent Vingt Journées de Sodome » du Marquis de Sade avait été dérobé à la famille de Nouailles puis acquis par un collectionneur suisse – Gérard Nordmann – qui a toujours refusé de la rendre. C’est grâce à un accord entre l’héritier des Nouailles et l’héritier Nordmann que le manuscrit a pu retourner en France, où il a été classé trésor national en 2017.
Masque Nalindele – Zambie et Personne privée
En juin 1989 le Masque Nalindele est volé au Musée national de Livingston en Zambie. En 1996 un antiquaire l’acquière à Paris. Apprenant qu’il s’agit d’un objet volé, il décide de le restituer aux autorités belges que le restitueront par la suite à la Zambie.
Morgantina Goddess Statue – Italy and J. Paul Getty Museum
An ancient statue of a goddess, which was likely illegally excavated in the late 1970s in Italy, was purchased by the J. Paul Getty Museum in 1988 for a record-setting US$18 million. That same year, Italian authorities began an investigation at the conclusion of which the Getty Museum agreed to consider returning the statue to Italy.
Nataraja Idol – India and the Norton Simon Foundation
In 1956, an ancient bronze statue of the Lord Siva (Lord of the Cosmic Dance or Sivapuram Nataraja) was removed from a temple in India for restoration purposes, subsequently held by an Indian private collector and ultimately sent to the United States with false export documents. In 1973, the Nataraja idol was sold by a New York dealer to the Norton Simon Foundation.
Nedjemankh and His Gilded Coffin – Metropolitan Museum of Art and Egypt
The gilded Coffin of Nedjemankh, a priest of the ram-god Heryshef, was purchased in 2017 and exhibited in 2018 by the Metropolitan Museum of Art. Following an investigation by the Manhattan District Attorney’s office, the Met learned that the Coffin had been looted in 2011, during the Egyptian revolution. It also learned that it had received upon its purchase a false ownership history, fraudulent statements and fake documentation, including a forged 1971 Egyptian export license for the coffin. As such, the Met unconditionally returned the coffin to the Government of Egypt.
Pièces d’or géantes – Inde c. Crédit Agricole Indosuez SA
Deux pièces d’or géantes anciennes d’une valeur exceptionnelle, tant d’un point de vue économique que culturel, sont mises en gage auprès d’une Banque à Genève par le petit-fils de l’ancien Nizam de la Principauté d’Hyderabad. L’Inde introduit une action auprès des tribunaux genevois dans le but d’en obtenir la restitution.
Portrait d’Isabelle d’Este – Cecchini c. Italie
Dans le cadre d’une procédure pénale, le procureur du Tribunal de Pesaro (Italie) a adressé à la Suisse une demande d’entraide judiciaire portant sur un tableau attribué à Leonardo da Vinci qui aurait été transféré d’Italie en Suisse, par sa propriétaire, sans l’autorisation des autorités italiennes. Après avoir fait séquestrer le tableau, le Ministère public du Tessin ordonne la remise de ce dernier à l’Italie. La propriétaire de l’œuvre recourt contre cette décision jusqu’au Tribunal fédéral, qui casse la décision précédente.
