IV. Adopted Solution/résolution du litige

The key words constitute in-house working definitions serving the purpose of facilitating the use of ArThemis. They may gradually change and evolve. Les définitions des mots-clés ont pour but d'aider dans la recherche d'affaires sur ArThemis. Ils peuvent encore graduellement changer et évoluer.

 

Conditional restitution/restitution sous condition

Restitution subject to one or more conditions agreed by the parties .

Restitution de l’objet soumise à une ou plusieurs condition(s) d’entente entre les parties.

Co-ownership/co-propriété

A legal concept according to which two or more entities (co-owners) share the legal ownership of a property.

Plusieurs personnes sont propriétaires, chacun pour sa quote-part, d’une chose qui n’est pas matériellement divisée.

Copy/copie

The exact reproduction of an object or relic.

La reproduction exacte d'un objet.

Cultural cooperation /coopération culturelle

The result of any agreement establishing forms and methods of mutually beneficial collaboration of the parties involved in a restitution claim such as the organisation of research programs, joint exhibitions, the exchange of interns.

Un accord incluant des mesures de coopération culturelle contenant des clauses spécifiques sur une collaboration culturelle telle que l’organisation de programmes de recherche, d’expositions conjointes, l’échange de stagiaires, etc.

Donation

An inter vivos gift, which may be gratuitous or onerous (Black’s Law Dictionary, 9th ed., 2009).

Acte juridique par lequel une personne (donateur) transmet sans contrepartie un objet à une autre personne (donataire)qui l'accepte.

Ex gratia payment/versement à titre gracieux

A payment not legally required, hence made as a favour (Black’s Law Dictionary, 9th ed., 2009).

Payement d’une somme d’argent sans obligation légale.

Exchange/échange

The act of transferring two (or more) objects, each in consideration for the other (Black’s Law Dictionary, 9th ed., 2009).

Le transfert entre des parties d’une ou de plusieurs propriété(s) appartenant à l’une des parties contre une ou plusieurs autres propriété(s) appartenant à l’autre partie.

Financial compensation/indemnisation Compensation corresponding to the market value of the property, or of a considerable amount.

Indemnisation correspondant à la valeur du bien sur le marché, ou à un montant considérable.

Loan/prêt

An act of lending something for temporary use (Black’s Law Dictionary, 9th ed., 2009).

Contrat par lequel le propriétaire d’une chose en autorise l’usage gratuitement à un tiers pour une durée de temps limité.

Repurchase/rachat

The purchase by a party of an object or share in the object it previously owned according to the conditions agreed upon between the seller and the (re-)purchaser.

Achat par une partie d’un objet qu’elle a antérieurement déjà possédé en général à défaut de pouvoir le revendiquer.

Request denied/rejet de la demande

The request is denied.

La demande en restitution du bien culturel est rejetée.

Sale/vente

The transfer of property for a price, under the following conditions: (1) parties competent to contract, (2) mutual assent, (3) a thing capable of being transferred, and (4) a price in money paid or promised (Black’s Law Dictionary, 9th ed., 2009).

Contrat par lequel un vendeur cède à un acheteur un objet contre le paiement d’une somme d’argent.

Shared custody/co-possession

The joint care and control of a thing for inspection, preservation, or security; it entails that rights, privileges and responsibilities are shared, though not necessarily the physical custody (Black’s Law Dictionary, 9th ed., 2009).

La gestion commune d’un objet et le partage des responsabilités comme la conservation et la sécurité sans pour autant partager le contrôle physique.

Symbolic gesture/geste symbolique

Any gesture undertaken by one or more of the parties involved in a restitution dispute in order to acknowledge either the cultural significance of the object at stake or the ethical issues involved; financial gesture, informative label next to the object when on exhibition, short-term loan, etc.

Toute mesure prise par une des parties qui marque la reconnaissance culturelle de l’objet pour l’autre partie ou les encore les enjeux éthiques. Ces mesures peuvent par exemple être un geste financier, une notice informative près de l’objet lors de son exposition, ou encore le prêt à court terme, etc.
