III. Legal issues/problèmes en droit

The key words constitute in-house working definitions serving the purpose of facilitating the use of ArThemis. They may gradually change and evolve. Les définitions des mots-clés ont pour but d'aider dans la recherche d'affaires sur ArThemis. Ils peuvent encore graduellement changer et évoluer.
Act of State The common law doctrine according to which municipal courts will not scrutinize the validity of the acts of foreign governments performed in their capacities as sovereigns within their own territories and against its own citizens (Brownlie I., Principles of Public International Law, 7th ed., Oxford University Press, 2008, p. 504).

Doctrine de common law qui interdit au tribunal du for de remettre en question les actes d’un gouvernement étranger souverain exercés dans son propre territoire et contre sa propre population.
Anti-seizure legislation/garantie de restitution National legal provisions granting immunity from enforcement proceedings (i.e. seizure) to objects temporarily loaned for exhibition purposes by foreign institutions (see, e.g., Articles 10 ff. of the Swiss Federal Act on the International Transfer of Cultural Property).

Législation nationale prévoyant l’immunité des biens culturels prêtés temporairement pour une exposition par une institution étrangère (voir par exemple les articles 10 ss. de la loi fédérale Suisse sur le transfert international des biens culturels).
Breach of contract/violation du contrat Violation of a contractual obligation by failing to perform one’s own promise, by repudiating it, or by interfering with another party’s performance (Black’s Law Dictionary, 9th ed., 2009).

Violation d’une obligation contractuelle consistant en général en l’inexécution ou en la mauvaise exécution  d’un engagement ou encore en interférent avec l’exécution de la partie cocontractante.
Choice of law/droit applicable The domestic rules developed by each State to help domestic judges to choose the applicable law when the administration of justice requires a choice between two or more systems of law, that is, in situations that present a foreign element; this element may relate to the parties, to the facts, or to the object of the litigation.
En situation internationale, règles de droit qui permettent de déterminer le droit applicable au cas d’espèce. Les critères peuvent être des éléments reliés aux parties, aux faits ou encore à l’objet du litige.
Criminal offence/infraction pénale An act committed or omitted in violation of a law and for which punishment is imposed upon conviction.

Violation d’une règle de droit qui impose un devoir d’abstention ou d’action et qui emporte des conséquences pour l’auteur comme une amende ou encore l’emprisonnement.  
Deaccession The removal of an object from a museum’s collection.

La sortie d’un objet de la collection d’un musée.
Due diligence The standard of conduct reasonably expected from a person who seeks to satisfy a legal requirement or to discharge an obligation; with respect to the art market, it refers to the obligation of any prospective buyer (either a professional or a dilettante) to investigate the origin of the artwork, whether it has been legally dealt with and the status of the transferor (see, e.g., Article 4 of the UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects of 1995). It also relates to the procedural constraints imposed on a party and resulting from the duty of due diligence.

Standard de comportement attendu d’une personne donnée afin de satisfaire à une obligation légale ou afin de ne pas être tenu pour responsable ; en regard du marché de l’art, le devoir de diligence concerne en particulier la provenance des objets lors de l’acquisition,  c’est-à-dire l’origine illicite ou non de l’objet (voir par exemple l’art. 4 de la Convention Unidroit de 1995 sur les biens culturels volés ou illicitement exportés). Cette notion se rapporte également aux contraintes de procédure liées au devoir de diligence exigé des parties.
Enforcement of foreign law/applicabilité du droit public étranger The recognition and application of foreign public laws by a court of the forum State.

La reconnaissance ou non par le juge du for du droit public étranger potentiellement applicable.
Expropriation A governmental taking (or modification) of an individual’s rights (Black’s Law Dictionary, 9th ed., 2009).

Le transfert de propriété, en général indemnisé, d’un bien en main privée en faveur de l’État.
Illicit excavation/fouille illicite The extraction of objects from a clandestine or an official archaeological site in contravention of the laws of the State of location (see, e.g., Article 3(2) of the UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects of 1995).

Un objet excavé d’un site archéologique clandestin ou officiel en violation des lois de l’État (voir par exemple article 3 al. 2  de la Convention Unidroit de 1995 sur les biens culturels volés ou illicitement exportés).
Illicit exportation/exportation illicite The export or transfer of ownership of cultural property effected contrary to the provisions adopted by the States (see, e.g., Article 3 of the UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Cultural Property of 1970).

La sortie d’un bien d’un état en violation des dispositions douanières et d’exportation qui visent à protéger le bien culturel (voir par exemple article 3 de la Convention UNESCO concernant les mesures à prendre pour interdire et empêcher l'importation, l'exportation et le transfert de propriété illicites des biens culturels de 1970).
Illicit importation/importation illicite Transfer of cultural property into the territory of a State on violation of the rules of that State (see, e.g., Article 3 of the UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Cultural Property of 1970).

L’importation d’un objet sur le territoire d’un État en violation de ses propres dispositions légales (voir par exemple article 3 de la Convention UNESCO concernant les mesures à prendre pour interdire et empêcher l'importation, l'exportation et le transfert de propriété illicites des biens culturels de 1970).
Inalienability/inaliénabilité The legal status of certain cultural asses that cannot be removed from a State’s patrimony (see, e.g., Article 13(d) of the UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Cultural Property of 1970).

Statut légal de certains objets culturels qui ne peuvent pas  en principe sortir du patrimoine de l’Etat (voir par exemple article 13(d) de la Convention UNESCO concernant les mesures à prendre pour interdire et empêcher l'importation, l'exportation et le transfert de propriété illicites des biens culturels de 1970).
Intellectual property/propriété intellectuelle “Intellectual property (IP) refers to creations of the mind: inventions, literary and artistic works, and symbols, names, images, and designs used in commerce” (see World Intellectual Property Organization online, www.wipo.int/about-ip/en/).

Jurisdiction/conflicts de juridiction Capacity of a court to solve a transnational dispute.

En cas de situation internationale, compétence du juge du for de se saisir de l’affaire.
Legacy/legs A gift by will, esp. of personal property (Black’s Law Dictionary, 9th ed., 2009).

Libéralités en faveur d’un tiers au moment de la succession.
Ownership/propriété The bundle of rights allowing one to use, manage and enjoy property, including the rights to possess a thing, regardless of any actual or constructive control, and to convey it to others (Black’s Law Dictionary, 9th ed., 2009).

Droit de libre disposition d’une personne sur une chose comme la jouissance ou le transfert de celle-ci.
Procedural issue/limites procédurales
Requirements of procedural nature, like the burden of proof, which may frustrate legal actions.

Obligations d’ordre procédural comme le fardeau de la preuve qui peuvent limiter les chances de succès d’une partie lors d’une action en justice.
State immunity/immunité des Etats The principle of international law according to which a State enjoys immunity, in respect of itself and its property, from the jurisdiction of the courts of another State (see, e.g., Article 5 of the United Nations Convention on Jurisdictional Immunities of States and Their Property of 2004).

Principe général de droit international public selon lequel un État jouit, pour lui-même et pour ses biens, de l’immunité de juridiction devant les tribunaux d’un autre État (voir par exemple article 5 de la Convention des Nations Unies sur l’immunité juridictionnelle des États et de leurs biens 2004).
State responsibility/responsabilité internationale des Etats The accountability of a State for the commission of a wrongful act, which may consists of an action or omission in breach of an international obligation of the State, such as the violation of a multilateral or bilateral treaty (see, e.g., Draft Articles 1 and 2 of the Draft Articles on Responsibility of States for Internationally Wrongful Acts, 2001).

Activité d’un Etat, consistant en une omission ou en une action, constitutive d’une violation d’une obligation internationale résultant par exemple d’un traité multilatéral (voir par exemple les articles 1 et 2 du Projet d'articles sur la responsabilité de l’État pour fait internationalement illicite).
Statute of limitation/prescription A domestic law establishing a temporal limit for bringing a legal action; after the expiry of the period specified in the statute any action is barred.

Limite temporelle qui interdit au demandeur de faire valoir en justice ses prétentions.
Tort /acte illicite

An unlawful act, whether intentional or accidental, from which injury occurs to another, leading to private law liability not based on contract but by operation of (statutory) law (Glossary of Arbitration and ADR Terms and Abbreviations, 4th ed., Swiss Arbitration Association, June 2009).

Dommage causé à autrui intentionnellement ou par négligence de manière contraire au droit.
