Biccherna Panel – Anonymous Heirs and British Library
In 2013, the British Library was contacted by the heirs of A.S. Drey, a Munich firm whose assets were sold off by Nazis in 1936. The heirs requested the return of the “Biccherna Panel” and lodged a claim with the UK Spoliation Advisory Panel, which found in favour of the claimants. However, following negotiations, the heirs accepted compensation in lieu of return, allowing the Biccherna Panel to remain in the British Library.
Chagall Gouache – Solomon R. Guggenheim Foundation and Lubell
In 1993, the Guggenheim Foundation, Mrs. Rachel Lubell, and other interested parties reached a settlement regarding a Marc Chagall painting that had been stolen from the Museum and purchased by Mrs. Lubell almost thirty years prior. Though a trial court had originally held the Guggenheim’s suit seeking recovery was time-barred, the Appellate Division reversed the lower court’s decision and clarified New York’s “demand and refusal” rule. On remand, the parties settled just one day after the new trial began.
Collection Varenne – Héritiers Varenne et Ville de Genève
En 2008, un accord est conclu entre la Ville de Genève et les héritiers Varenne portant sur la collection « Varenne ». La Ville de Genève renonce à la donation « Varenne » initiale en échange notamment de CHF 30.000.000.
Jardin à Auvers – Agent judiciare du Trésor c. Walter
Dans son arrêt du 20 février 1996, la Cour de Cassation de la France a condamné l’Etat français à indemniser le propriétaire d’un tableau dont l’exportation avait été refusée pour cause de classement d’office.
Lighthouse With Rotating Beam – Flechtheim Heirs and Kunstmuseum Bonn
The heirs of the art dealer and collector Alfred Flechtheim besought the Kunstmuseum Bonn for the restitution of the painting “Lighthouse With Rotating Beam” by Paul Adolf Seehaus, alleging that it was part of Alfred Flechtheim’s collection before he fled Nazi persecution. After consideration of the claim, the Museum decided to keep the painting, but agreed to reimburse the heirs for half its market value.
Mandat signé par Jean Calvin - République et canton de Genève et Sotheby's
En novembre 2016, il est porté à la connaissance de l’archiviste d’État de Genève qu’un document datant du XVIe siècle et volé probablement au XIXe siècle figure sur le catalogue de la prochaine vente aux enchères de Sotheby’s à New York. Un accord d’indemnisation est signé le 1er septembre 2017 entre Sotheby’s, le possesseur et deux intervenants privés. Le même jour, un accord distinct de restitution est signé entre la République et canton de Genève, Sotheby’s et le possesseur.
Manuscrit du Marquis de Sade – Héritier Nordmann et héritier de Noailles et Gérard Lhéritier
Les « Cent Vingt Journées de Sodome » du Marquis de Sade avait été dérobé à la famille de Nouailles puis acquis par un collectionneur suisse – Gérard Nordmann – qui a toujours refusé de la rendre. C’est grâce à un accord entre l’héritier des Nouailles et l’héritier Nordmann que le manuscrit a pu retourner en France, où il a été classé trésor national en 2017.
Portrait of a Young Peasant – Beyeler v. Italy
In its judgment of 5 January 2000, the European Court of Human Rights held that the Italian State violated Mr. Beyeler’s right to peaceful enjoyment of his possessions while using its pre-emption right over the Van Gogh painting “Portrait of a Young Peasant”.
Portrait of Wally – United States and Estate of Lea Bondi and Leopold Museum
After having been taken from Lea Bondi, a Jew forced to flee Austria following the Anschluss, the painting “Portrait of Wally” by Egon Schiele was seized by the US Forces at the end of the war. The portrait was first returned by the US Restitution Division to the Austrian Federal Office for Preservation of Historical Monument (BDA).
Sumpflegende – Héritiers Lissitzky-Küppers et Ville de Munich
Après 25 ans de litige juridique et de négociation, le sort de « Sumpflegende », un tableau de Paul Klee prêté à une galerie allemande en 1926 puis confisqué par les Nazis au titre d’art « dégénéré », est scellé. En juillet 2017, les héritiers de Sophie Lissitzky-Küppers, laquelle avait prêté le tableau, concluent un accord avec la Ville de Munich et une fondation privée. L’œuvre reste exposée dans un musée munichois et les héritiers Lissitzky-Küppers sont indemnisés.
Two Bronze Animal Heads – China and Pierre Bergé
In February of 2009, Christie’s offered at auction two 18th-century bronze fountainheads – a rabbit and a rat – owned by the estate of Yves Saint Laurent and his longtime-partner Pierre Bergé. Stolen from the Old Summer Palace by British and French forces during the Second Opium War in 1860, the two heads’ sale provoked controversial international debate, inspiring a Chinese national to bid upon the bronzes at auction and refuse payment. In June of 2013, François-Henri Pinault, owner of Christie’s, returned to China the fountainheads in an effort to strengthen diplomatic and trade relations between France and China.
Two Lithographs of the Glaser Collection – Glaser Heirs and Kunstmuseum Basel
In 1933, the Kunstmuseum Basel purchased about 200 drawings and prints at the Max Perl auction in Berlin. These works belonged to Curt Glaser, a Jewish art collector and director of the Art Library in Berlin. In 2004, the Glaser heirs requested the Kunstmuseum to return two artworks by Edvard Munch, but the Museum refused. Following negociations, the Kunstmuseum Basel and the heirs of Curt Glaser reached a seemingly “just and fair solution”.
Vallée de la Stour – Héritiers Jaffé et La Chaux-de-Fonds
En 2006, la Ville de La Chaux-de-Fonds reçoit une demande de restitution pour le tableau « La Vallée de la Stour » de John Constable exposé au Musée des beaux-arts de La Chaux-de-Fonds. Le requérant représente les ayants droit héritiers de John et Anna Jaffé, dont les biens, y compris ce tableau, ont été spoliés par les Nazis durant la Deuxième Guerre mondiale. Après avoir d’abord refusé, la Ville accepte de restituer le tableau à l’automne 2017 suite à une procédure de conciliation judiciaire. Le Tableau est restitué aux héritiers le 12 mars 2018.
Warehouse Fire – Gillian Ayres et al. and Momart
One of the most significant cases in Great Britain in the recent years concerns the Momart Warehouse Fire, where a warehouse owned by Momart burned down in 2004 causing the destruction of a great amount of artworks by renowned British artists (the Brit Art movement). Following the filing of a class action, Momart decided to mediate the case and to settle by a secret payout.
Wasco Sally Bag – American dealer and Paul Cary and the Yakama Nation Museum
In 2007, Paul Cary acquired a Wasco Sally bag, an object from the Native American group, the Yakama Nation, from an American dealer. When Paul Cary learned that the bag was stolen from the Yakama Nation Museum, he returned it to the dealer and informed the museum. Subsequent negotiations initiated between the museum and the dealer would have remained unfruitful, if it was not for the involvement of Paul Cary. He offered the dealer financial compensation for half of his losses should he return the bag to the museum. Moreover, he would attempt to obtain the financing of the second half from the Yakama tribe. The parties agreed.
