Murals of Teotihuacán – Fine Arts Museums of San Francisco and National Institute of Anthropology and History

In 1978, the Fine Arts Museums of San Francisco became the owner of a number of murals from the world-famous Aztec site of Teotihuacán (Mexico). The Mexican Government failed in its attempts to obtain the return of these wall paintings through a court action in the United States.

Waurà Indians Collection – Museum der Kulturen Basel, Penteado Coelho Heirs and Museu de Arqueologia e Etnologia Universidade de São Paulo, Waurà Indians

Vera Penteado Coelho, a Brazilian ethnologist, bequeathed to the Museum der Kulturen Basel her collection of Waurà cultural objects. Following opposition from the Waurà Indians and the Museu de Arqueologia e Etnologia Universidade de São Paulo, the Basel Museum entered into negotiations to allow the collection to remain in Brazil. Eight years later, in 2008, the collection was donated to the São Paulo Museum.

Tête égyptienne fragmentaire – Musée d’ethnographie de Neuchâtel et Service des antiquités de l’Egypte

En 1926, l’archéologue Gustave Jéquier, collaborateur du Musée ethnographique de Neuchâtel, obtient en négociant avec le Service des antiquités d’Egypte, divers objets égyptiens précieux en échange d’une tête monumentale fragmentaire découverte et ramenée d’Egypte la même année. Cette tête est alors retournée au Musée égyptien du Caire.

Chasuble – Paraguay et Musée d’ethnographie de Neuchâtel et François Machon

En 1889, le Musée d’ethnographie de Neuchâtel (MEN) reçoit en don une chasuble probablement spoliée au Paraguay pendant la guerre de la Triple Alliance (1864-1870). En 1926, le médecin neuchâtelois François Machon, alors Consul du Paraguay à Lausanne, propose au MEN le retour de la chasuble en échange du don de sa collection ethnographique, ce que le MEN accepte.

200 Paintings – Goudstikker Heirs and the Netherlands

The art collection of Jacques Goudstikker was acquired by the Nazi commander Hermann Göring under suspicious circumstances during the Second World War. A large part of the collection was recovered by the Allied Forces after the war and it was subsequently returned to the Netherlands where it was labelled “Dutch national property”. The first part of these items was bought back by Goudstikker’s wife under a settlement agreement of 1952. The Dutch Government returned the second part – 200 paintings – to Marei Von Saher (the only surviving heir of Jacques Goudstikker) in 2006 based on a recommendation of the Dutch Restitution Committee.

Warehouse Fire – Gillian Ayres et al. and Momart

One of the most significant cases in Great Britain in the recent years concerns the Momart Warehouse Fire, where a warehouse owned by Momart burned down in 2004 causing the destruction of a great amount of artworks by renowned British artists (the Brit Art movement). Following the filing of a class action, Momart decided to mediate the case and to settle by a secret payout.

Portrait of Wally – United States and Estate of Lea Bondi and Leopold Museum

After having been taken from Lea Bondi, a Jew forced to flee Austria following the Anschluss, the painting “Portrait of Wally” by Egon Schiele was seized by the US Forces at the end of the war. The portrait was first returned by the US Restitution Division to the Austrian Federal Office for Preservation of Historical Monument (BDA).

17 Tasmanian Human Remains – Tasmanian Aboriginal Centre and Natural History Museum London

Since the 1980s, the Tasmanian Aboriginal Centre has made several requests to the Londoner Natural History Museum for the return of 17 Aboriginal human remains held in the collection of the Museum. When their dispute was brought to the Londoner High Court, the court’s judge suggested proceeding by mediation. The dispute was ultimately settled by a mediated agreement, which provided for the dismissal of the legal proceedings and for the repatriation of the remains to Tasmania.

Euphronios Krater and Other Archaeological Objects – Italy and Metropolitan Museum of Art

In February 2006, the Italian Ministry for Cultural Heritage and Activities and the Metropolitan Museum of Art (MET) of New York entered into a landmark agreement with which the ownership title to the Euphronios Krater and other archaeological artefacts was transferred to the Italian Government.
