Par une délibération du 19 octobre 2007, le Conseil Municipal de la Ville de Rouen autorise la restitution d’une tête maorie détenue dans les collections du Musée de la Ville de Rouen depuis 1875. L’autorisation est annulée par le Tribunal administratif de Rouen et par la Cour d’appel de Douai. En 1992, la Ville de Genève décide de restituer une tête maorie appartenant aux collections du Musée d’ethnographie de la Ville de Genève à la Nouvelle-Zélande sous la forme d’un prêt. En 1838, Badu Bonsu II, roi des Ahanta du Ghana, est condamné à mort par les autorités coloniales néerlandaises. Il sera pendu et décapité. Sa tête sera transportée aux Pays-Bas. Sarah Baartman, a South African woman of Khoisan origin, also known as the “Hottentot Venus”, was exhibited as a freak show attraction in London and Paris in the 19th century. The skeleton of a 9,000 year old man was discovered on Federal territory near the city of Kennewick, Washington. Authorities decided to grant the request of five American Indian tribes, and transferred the remains to those tribes for burial. Several scientists, including Robson Bonnichsen, opposed the return and filed suit in the District Court of Oregon. Finding that evidence was not sufficient to link the remains to any present-day American Indian tribe, the District Court vacated the authority’s decision and ordered further examination of the remains. Inakayal was a leader of the Tehuelche people, a native tribe of Patagonia (Argentina). In 1884, he was captured by the Argentinian army. En 1878, le grand chef Ataï fût tué lors de la rébellion de son clan contre l’accaparement des terres par les colonisateurs français. Devenu le symbole de la lutte contre le colonialisme français en Nouvelle-Calédonie, sa tête a été mise à prix avant de devenir propriété de la Société d’Anthropologie de Paris (SAP). Dès les accords de Matignon en 1988, la France a promis le retour du crâne d’Ataï. Since the 1980s, the Tasmanian Aboriginal Centre has made several requests to the Londoner Natural History Museum for the return of 17 Aboriginal human remains held in the collection of the Museum. When their dispute was brought to the Londoner High Court, the court’s judge suggested proceeding by mediation.
