Poster Collection – Sachs Heirs v. Foundation German Historical Museum

Hans Sachs began collecting posters from the end of the nineteenth century. This collection was considered lost as a result of its seizure by the Nazis in 1937. In 2005, Peter Sachs, as Hans Sachs’ son and sole heir, located his father’s collection at the German Historical Museum and demanded its restitution. An ancient statue of a goddess, which was likely illegally excavated in the late 1970s in Italy, was purchased by the J. Paul Getty Museum in 1988 for a record-setting US$18 million. Au printemps 2004, le Musée de Melbourne organise une exposition d’œuvres sur écorces aborigènes. Parmi les biens présentés figurent deux anciennes gravures sur écorces prêtées par le British Museum et les Kew Royal Botanic Gardens. La tribu australienne Dja Dja Wurrung bloque le retour de ces objets en Angleterre. En 2006, la Ville de La Chaux-de-Fonds reçoit une demande de restitution pour le tableau « La Vallée de la Stour » de John Constable exposé au Musée des beaux-arts de La Chaux-de-Fonds. Le requérant représente les ayants droit héritiers de John et Anna Jaffé, dont les biens, y compris ce tableau, ont été spoliés par les Nazis durant la Deuxième Guerre mondiale. Après avoir d’abord refusé, la Ville accepte de restituer le tableau à l’automne 2017 suite à une procédure de conciliation judiciaire. Après 25 ans de litige juridique et de négociation, le sort de « Sumpflegende », un tableau de Paul Klee prêté à une galerie allemande en 1926 puis confisqué par les Nazis au titre d’art « dégénéré », est scellé. En juillet 2017, les héritiers de Sophie Lissitzky-Küppers, laquelle avait prêté le tableau, concluent un accord avec la Ville de Munich et une fondation privée. Vera Penteado Coelho, a Brazilian ethnologist, bequeathed to the Museum der Kulturen Basel her collection of Waurà cultural objects. Following opposition from the Waurà Indians and the Museu de Arqueologia e Etnologia Universidade de São Paulo, the Basel Museum entered into negotiations to allow the collection to remain in Brazil. Eight years later, in 2008, the collection was donated to the São Paulo Museum. In 1978, the Fine Arts Museums of San Francisco became the owner of a number of murals from the world-famous Aztec site of Teotihuacán (Mexico). The collection was probably illicitly excavated in Troy, a city in Northwest Turkey. In May of 2002, the British Museum was confronted with a restitution claim by the heirs of the Second World War victim, Arthur Feldmann, regarding four Old Master drawings. The Commission of Looted Art Europe, who represented the claimant, and the British Museum, jointly sought guidance from the Spoliation Advisory Panel. After deferral of the Attorney General, the High Court held that under the British Museum Act the Museum could not restitute an object in order to meet a moral obligation without an Act of Parliament. These paintings were featured in frequent exhibitions of LACMA’s Korean art galleries until the Jogye Order of Korean Buddhism notified LACMA that the paintings were stolen. In 2003, 14 artworks by the Russian artist Kazimir Malewicz were exported to the United States by the Stedelijk Museum of Amsterdam to be part of a temporary exhibition at the Guggenheim Museum in New York and the Menil Collection in Houston. In 2017, the government of Thailand formally requested that the United States restitute two ancient stone lintels of Khmer origin that had been removed from Thai temples between 1959–1968 and acquired by the Asian Art Museum in San Francisco. From 2017 to 2020, the United States and Thailand negotiated with the Museum for the restitution of the lintels, but in October 2020, the United States sued the Museum in federal court to seek their forfeiture.
