3000 Archeological Objects – China and Two British Dealers
https://plone.unige.ch/art-adr/cases-affaires/3000-archeological-objects-2013-china-and-two-british-dealers
On 10 February 1998, the Chinese government and two British dealers signed an out-of-court agreement that resolved the question of ownership of over 3000 archaeological objects. Most probably these were transferred to the United Kingdom through illegal excavation and trafficking. No publisherOwnership/propriétéIllicit exportation/exportation illiciteNegotiation/négociationJudicial claim/action en justiceBritish Dealers/marchands d'art anglaisArchaeological object/objet archéologiqueUnconditional restitution/restitution sans conditionChina/ChineIllicit excavation/fouille illiciteSettlement agreement/accord transactionnelPost 1970 restitution claims/demandes de restitution post 19702017/01/16 11:10:00 GMT+1Page La Bergère – Meyer Heirs and Fred Jones Jr. Museum of Art

Raoul Meyer’s art collection, which included Camille Pissarro’s painting “La bergère rentrant des moutons”, was looted by Nazi troops during the occupation of France in early 1940s. Decades later, Meyer’s daughter and heir, Léone Meyer, discovered the painting at the Fred Jones Jr. Museum of Art at the University of Oklahoma, and initiated a lawsuit in the United States seeking its return. After a three-year litigation, the two sides reached a settlement in 2016. The latter was denounced by Ms. Meyer. Eventually, the lawsuit was dropped and ownership of the painting was transferred to the Fred Jones Jr. Museum of Art. Hans Sachs began collecting posters from the end of the nineteenth century. This collection was considered lost as a result of its seizure by the Nazis in 1937. In 2005, Peter Sachs, as Hans Sachs’ son and sole heir, located his father’s collection at the German Historical Museum and demanded its restitution. A judgment of the German Federal Court of Justice made possible the return of the poster collection to Peter Sachs. No publisherUnconditional restitution/restitution sans conditionJudicial claim/action en justiceConciliationHans SachsFoundation German Historical MuseumProcedural issue/limites procéduralesArchivesJudicial decision/décision judiciaireNazi looted art/spoliations naziesOwnership/propriétéNegotiation/négociation2017/01/24 15:55:00 GMT+1PagePortrait of a Youth – Reichel Heirs v. Four mosaics were stolen from the Cypriot Church of the Panagia Kanakaria in Lythrankomi, following the Turkish military intervention in Cyprus of 1974. Afterwards, they were purchased by an American art dealer, Peg Goldberg. In May of 2002, the British Museum was confronted with a restitution claim by the heirs of the Second World War victim, Arthur Feldmann, regarding four Old Master drawings. The Commission of Looted Art Europe, who represented the claimant, and the British Museum, jointly sought guidance from the Spoliation Advisory Panel. After deferral of the Attorney General, the High Court held that under the British Museum Act the Museum could not restitute an object in order to meet a moral obligation without an Act of Parliament. Eventually, the British Museum followed the recommendation of the Spoliation Advisory Panel and compensated the family with an ex gratia payment. No publisherDeaccessionArtwork/oeuvre d’artInstitutional facilitator/facilitateur institutionnelEx gratia payment/versement à titre gracieuxJudicial claim/action en justiceArthur FeldmannNegotiation/négociationSettlement agreement/accord transactionnelBritish Museum2012/11/12 15:45:00 GMT+1PageSix Klimt paintings – Maria Altmann and Austria

Maria Altmann brought suit in the United States against the Republic of Austria and the Austrian National Gallery to recover six paintings by Gustav Klimt that the Nazis took during the Second World War from her Jewish relatives, Ferdinand and Adele Bloch-Bauer. Although the Supreme Court of the United States lifted Austria’s jurisdictional immunity, the disputants reached an agreement to end the litigation and submit the dispute to arbitration in Austria. The arbitration panel ruled that Austria was obliged to return five of the Klimt’s masterpieces to Maria Altmann. No publisherJudicial decision/décision judiciaireConciliationArtwork/oeuvre d’artState immunity/immunité des EtatsArbitral award/décision arbitraleInstitutional facilitator/facilitateur institutionnelArbitration/arbitrageJudicial claim/action en justiceMaria AltmannUnconditional restitution/restitution sans conditionAustria/AutricheNazi looted art/spoliations naziesOwnership/propriétéFerdinand and Adele Bloch-BauerAustrian National Gallery2012/11/13 15:55:00 GMT+1PageHerzog Collection – De Csepel et al. v. During World War II, the collection was seized by the Hungarian government, under Nazi orders. For the last seven decades, the Herzog Heirs have attempted to reclaim the Collection from the Republic of Hungary, without success.
