200 Paintings – Goudstikker Heirs and the Netherlands

The art collection of Jacques Goudstikker was acquired by the Nazi commander Hermann Göring under suspicious circumstances during the Second World War. A large part of the collection was recovered by the Allied Forces after the war and it was subsequently returned to the Netherlands where it was labelled “Dutch national property”. The first part of these items was bought back by Goudstikker’s wife under a settlement agreement of 1952. The Balangiga Bells were removed in 1901 from the parish church of San Lorenzo de Martir in Balangiga, Eastern Samar, in the Philippines, by soldiers of the United States Armed Forces. En 1838, Badu Bonsu II, roi des Ahanta du Ghana, est condamné à mort par les autorités coloniales néerlandaises. Il sera pendu et décapité. Sa tête sera transportée aux Pays-Bas. En juin 2015, le Ministère de la culture polonais apprend qu’un buste de Diane, spolié durant la Seconde Guerre mondiale et disparu depuis, va prochainement être vendu à Vienne par la maison de vente Auktionshaus im Kinsky. Le Ministère contacte alors la société Art Recovery International. Fin 2010, lors d’un contrôle d’inventaire aux Ports francs de Genève, l’Administration fédérale des douanes découvre un exceptionnel sarcophage romain représentant les douze travaux d’Hercule. Suspicieuse, l’Administration séquestre le bien. La Turquie se constitue comme partie plaignante dans la procédure pénale ouverte à Genève, se déclarant légitime propriétaire du sarcophage. En 2015, le Ministère public genevois ordonne la restitution de l’objet à la Turquie. Le détenteur du sarcophage recourt en vain devant la Cour de Justice puis au Tribunal fédéral, avant de se rétracter. In 2007, Paul Cary acquired a Wasco Sally bag, an object from the Native American group, the Yakama Nation, from an American dealer. When Paul Cary learned that the bag was stolen from the Yakama Nation Museum, he returned it to the dealer and informed the museum. Subsequent negotiations initiated between the museum and the dealer would have remained unfruitful, if it was not for the involvement of Paul Cary. He offered the dealer financial compensation for half of his losses should he return the bag to the museum. Moreover, he would attempt to obtain the financing of the second half from the Yakama tribe. The Cranach diptych “Adam and Eve” was presumably part of Jacques Goudstikker’s collection looted by the Nazis during the Second World War. For several years, Goudstikker’s sole heir, Marei von Saher, and the Norton Simon Museum in California have led unsuccessful negotiations regarding the heir’s restitution claim. Notwithstanding the support received by the State of California and by several organizations, Marei von Saher’s claims in replevin were dismissed by both the District Court for the Central District of California and by the Court of Appeals for the Ninth Circuit. En 1940, Jakob Goldschmidt, banquier juif et grand collectionneur d’art se voit retirer la nationalité allemande par le régime nazi qui s’approprie, par la suite, son patrimoine. Deux de ses tableaux du peintre Toulouse-Lautrec sont alors vendus aux enchères publiques et acquises par Jakob Koerfer qui en fait cadeau à sa femme, résidant en Suisse. Au décès de cette dernière, les tableaux sont dévolus aux enfants du couple. En 1956, Alfred Erwin Goldschmidt ouvre contre Jakob Koerfer et ses enfants une action en restitution des tableaux litigieux. Sa demande est rejetée en dernière instance par le Tribunal fédéral selon lequel les héritiers Koerfer sont, d’après le droit suisse, valablement devenus propriétaires des tableaux litigieux.

En 2013, la Namibie a adressé à l’Allemagne une requête en restitution d’une bible et d’un fouet witbooi. Ces objets, dont était propriétaire le héros national namibien Hendrick Witbooi, ont été spoliés par les troupes allemandes en 1893, lors d’une attaque menée par ces dernières contre la ville de Hornkranz afin de taire les soulèvements de la population contre l’occupation militaire allemande. Après des années de négociation, l’État allemand a finalement accepté de rendre les objets demandés.
