One-Thousand-Five-Hundred-Pound, Hand-Carved Lintels Removed from Religious Temples in Thailand – United States of America and City & County of San Francisco

In 2017, the government of Thailand formally requested that the United States restitute two ancient stone lintels of Khmer origin that had been removed from Thai temples between 1959–1968 and acquired by the Asian Art Museum in San Francisco. From 2017 to 2020, the United States and Thailand negotiated with the Museum for the restitution of the lintels, but in October 2020, the United States sued the Museum in federal court to seek their forfeiture. In 1972, five rare Maori wooden panels were discovered in a swamp in New Zealand’s North Island. Shortly after the discovery, the panels were illegally exported out of the country by an antiquities dealer and then bought by Swiss collector George Ortiz. Artists from the 555 Nonprofit Studio/Gallery removed an endangered mural painting by the graffiti artist Banksy from a derelict site in Detroit. The owner of the site, Bioresource, Inc. subsequently filed suit with the Wayne County Circuit Court requesting the wall art’s restitution. In 1993, the Guggenheim Foundation, Mrs. Rachel Lubell, and other interested parties reached a settlement regarding a Marc Chagall painting that had been stolen from the Museum and purchased by Mrs. Lubell almost thirty years prior. Though a trial court had originally held the Guggenheim’s suit seeking recovery was time-barred, the Appellate Division reversed the lower court’s decision and clarified New York’s “demand and refusal” rule. In 1935, Nazi authorities took from Jakob and Rosa Oppenheimer a painting entitled “Road to Calvary” by Brunswijker Monogrammist and sold it at auction. The painting resurfaced in 2006 when a Dutch private individual brought it to Sotheby’s determined to sell it. Instead of asking for the painting’s restitution, the Oppenheimer heirs demanded a portion of the sale’s proceeds. After an initial unsuccessful attempt to negotiate the dispute regarding a suitcase between the heirs of the Holocaust victim Pierre Lévi and the Auschwitz Birkenau State Museum in Oswiecim, the heirs decided to file a restitution claim against the Museum. In 1997, 111 panels originally forming a window of the St. Marienkirche (St Mary Church) in Frankfurt-on-the-Oder were located in the Russian State Hermitage Museum. They were brought to Russia by Soviet troops following World War II. In 2001, after difficult negotiations, Russia agreed to return the panels to Germany. In exchange, the German Government offered to finance the reconstruction of the Russian Orthodox Church of the Dormition of the Mother of God located near Novgorod.
